Terms and Conditions of booking Accommodation and Purchasing products or services through the Visitmacedonranges.com website

GUEST OR CLIENT SHOPPER

1. Accommodation bookings are only available online

2.Payment is made in full online at the time of booking for all transactions

3.We will issue you with a confirmation certificate/email at the time of making the booking and your credit card issuer has accepted the charges.

4.Upon arrival at the Accommodation or Package Delivery location, the operator will ask to sight:

• your credit card used to pay for the booking
• your drivers’ licence and
• the confirmation certificate
• and you will be required to sign the operator’s copy of the confirmation certificate

5. A no-refunds policy applies to bookings and shopping transactions made on the visitmacedonranges.com website. This includes shopping and event related purchases, and includes accommodation purchases that may also be managed by www.trippers.com, www.takeapeek.com or other affiliated providers.

 6.Every effort is made to ensure all information displayed on our site is accurate; however, as considerable information is accessed from our accommodation operators and package/shopping suppliers, we not able to guarantee the accuracy of all information nor are we able to guarantee that the site is free of errors or faults. We reserve the right to change information displayed on our site (including these terms and conditions) at any time without notice to you.
 
7.Without affecting any of your statutory rights that cannot be lawfully excluded, we will not be liable for any losses, damages, liability, claims or expenses (whatsoever and irrespective of whether direct, indirect, consequential) arising from the use of or connected with our site or any products or services purchased on our site. We make no warranty or representation as to the fitness or suitability of any product or service displayed on our site. We sell accommodation from inventory supplied by each accommodation operator and package/product supplier and we do not over-sell that inventory. We cannot accept liability for unavailability of rooms caused by an accommodation operator or package supplier over-selling its own inventory.

8.Please direct complaints to the individual operator or supplier.

9.The accommodation operator or the package supplier, as applicable, is not responsible for the security of your belongings. Please ensure that your accommodation is locked and secure when not occupied. Notify the accommodation operator or package supplier, as applicable, of any loss or damage to property.

10.We are not responsible for the failure of essential services, utilities and appliances. Please make problems known to the accommodation operator or package supplier.

Terms and Conditions of Supplier Agreement

By supplying details and offers through visitmacedonranges.com ("us", "we", "our"), Suppliers ("you") agree to the following terms and conditions, in conjunction with the specific terms of trade already notified to you:

1. DEFINITIONS

1.1 Accommodation includes rooms in hotels, motels, serviced apartments, bed and breakfasts or other accommodation.

1.2 Accommodation Data means data pertaining to the displayed accommodation, including supplier details, room capacity, bedding configuration, rack rates, charges for extra guests or facilities, cancellation policies and ratings listed by you that you propose to offer to the public through the Site for the Advertised Price.

1.3 Advertised Price is the displayed accommodation rate, including any extra charges specified in the Accommodation Data.

1.4 Guest means a person who books accommodation through the Site.

1.5 Nett Price means the Advertised Price less our agreed margin.

1.6 Site means our website, designed constructed and maintained by us, that offers the facility to book accommodation to the public at large.

2. REPRESENTATIONS AND WARRANTIES

2.1 You represent and warrant that:

1. You are the owner or are legally authorised to act on behalf of the owner of the Accommodation.

2. The Accommodation Data and the Accommodation comply with all applicable laws, statutes, ordinances and regulations.

2. We do not guarantee continuous, uninterrupted, or secure access to the Site, as the operation of the Site may be interfered with by numerous factors outside our control.

3. The booking service is not liable for any damages that occur as a result of a booking made via the website.

3. INDEMNITIES AND RELEASES

3.1 You indemnify us against liability or loss arising from, and cost incurred in connection with, damage, loss, injury or death to any third party caused or contributed to by your act, neglect or default, or the act, neglect or default of your servants and agents;

3.2 You release us from, and agree that we are not liable for:

1. Damage, loss or injury to you arising from, and cost incurred in connection with, the use of the Site unless it is caused by an act, neglect or default of ours or our agents;

2. Damage, loss or injury incurred in connection with the Site being interrupted, unavailable or not working properly, however caused.

4. SITE SECURITY

4.1 We shall provide you with relevant passwords to access the Site.

2. You agree not to publish, or make available, your password to any third party.

3. In the unlikely event that your password is used without your express permission you will be responsible for any loss of business or other damages that might occur or flow from the unauthorised access

5. SITE CONTENT

5.1 You are solely responsible for the Accommodation Data.

5.2 You agree that you shall not transmit on or through the Site any material that is, inappropriate, unlawful, obscene, threatening, abusive, defamatory, encourages behavior that may give rise to criminal activity, is considered adult content, is a breach of intellectual property or may give rise to civil liability.

5.3 We may remove, at our sole discretion, any offending or inappropriate material from the Site without notice.

5.4 We may make changes to the Site without notice to you.

5. We may make changes to this agreement from time to time. Changes will be posted on the Site and you will be advised of such changes.

6. BOOKINGS AND PAYMENT

1. We will accept bookings from Guests at the Advertised Price as an independent reseller.

2. Your entry on the website must include full Accommodation Data.

3. You agree to provide Accommodation in accordance with the Accommodation Data for each booking as notified by us.

4. Upon the Guest's registration in accordance with the booking, you must sight the registering Guest's (or Guests') credit card and valid photo identification to confirm the identity of the Guest. You must ensure that the guest signs your copy of the confirmation certificate at the time of check-in. You must also copy and retain photo identification on file for a period of six months from the date of registration of the booking. This procedure helps to protect both your interests and ours. You will supply this identification information to us on request.

5. You agree to provide Accommodation to the Guest for the rate as contained in the Accommodation Data supplied by you and as displayed on the site

6. Upon acceptance of the accommodation charges by the offered credit card, we will remit to you the total amount received less the agreed commission.

7. We shall remit payment direct to your nominated bank account

8. We shall forward confirmation of the booking and booking payment to the Guest together with your contact details. It is a requirement that you contact the Guest(s) within 24 hours of the booking being received.

9. A recipient generated tax invoice for the total amount owing for the booking less the agreed commission will be emailed to you for your records.

10. If a Guest fails to register in accordance with the booking or seeks to modify the booking, they will be directed to discuss the matter direct with you and you will negotiate direct with the Guest in regard to any fees that might apply

    A no-refunds policy applies to and is visible to customers making bookings and transactions on the visitmacedonranges.com website. This includes shopping and event related purchases, and includes accommodation purchases that may also be managed by www.trippers.com. Contact details for the operators and suppliers are noted on the confirmation certificate issued at the time of the booking. Visitmacedonranges.com will not refund the commission component of a purchase in the event of any customer refund.

7 INFORMATION AND INTELLECTUAL PROPERTY RIGHTS

7.1 You acknowledge that we own all right, title and interests to the Site, search technology and the visitmacedonranges.com brand, and that you will not acquire any right, title or interest in or to the Site, and that all of the software used on the Site are subject to copyright.

8 TERMINATION

8.1 Either party may terminate this agreement by giving to the other party at any time notice by email of its termination of this agreement.

1. On termination by us, we will deactivate your passwords and remove the Accommodation Data from the Site.

2. On termination by you, you will remove the Accommodation Data from the Site.

3. On receipt of notice of termination by you, we will deactivate your passwords.

8.2 You acknowledge that:

1. You have no claim for compensation or otherwise from us if the agreement is terminated under this clause 8, save for any claim for payment made pursuant to clause 6.

2. You will honour all bookings made up to and including the date of termination for Accommodation to be provided after the date of termination; and

3. On termination by you, you will honour all bookings made between the date of termination and the date the Accommodation Data is removed from the Site for any accommodation that is to be provided after the date of termination.

9 APPLICABLE LAW

9.1 The law in force in the State of Victoria, Australia, applies to this agreement.
